Agreed Terms
1. Buyer Responsibilities
- 1.1 To purchase an item, the Buyer must:
- Provide accurate contact information and delivery details to the Seller using XMTP unless the Buyer and Seller mutually agree to use a different communication method.
- Ensure that the delivery address is secure and accessible to prevent issues such as porch piracy.
- The Seller has the right to refund and cancel any order prior to shipping.
- 1.2 The Buyer is responsible for all applicable VAT, import taxes, or tariffs associated with the shipment of the item to their location.
2. Fulfillment by the Seller
- 2.1 The Seller must:
- Ship the item to the Buyer’s provided address by the agreed Settle Deadline.
- Ensure that the item is adequately packaged to protect the item from damage during shipping.
- Provide delivery confirmation, such as a tracking number or proof of shipment.
3. Escrow and Payment Release
- 3.1 Payments are held in a 2-of-3 multi-signature escrow smart contract until:
- The Buyer confirms receipt of the item and calls the
Settle()
function.
- The Settle Deadline passes without a dispute being filed, at which point the Seller is able to settle the payment.
- 3.2 If the Buyer does not receive the item, or it is not as described, they must file a dispute before the Dispute Period ends.
4. Dispute Resolution
- 4.1 In the event of a dispute, the Buyer and Seller should first attempt to resolve the issue directly.
- 4.2 If unresolved, the Buyer can escalate the dispute to the designated Arbiter, who will:
- Review evidence provided by both parties.
- Decide how the escrowed funds are distributed based on the evidence and agreed terms.
- 4.3 The Arbiter’s decision is final and cryptographically enforced.
5. Liability for Porch Piracy
- 5.1 Once the Seller provides valid proof of delivery (e.g., carrier tracking showing delivered status, or delivery confirmation), the Buyer assumes responsibility for the item.
- 5.2 The Buyer is liable for losses due to porch piracy, theft, or any issues after the item is marked as delivered.
6. Evidence Requirements for Disputes
- 6.1 From the Seller:
- Proof of shipment (e.g., receipt, tracking number).
- Proof of delivery (e.g., tracking status, delivery confirmation, or image of the package at the destination).
- Detailed photos showing the physical condition of the item prior to shipping.
- 6.2 From the Buyer:
- Evidence supporting claims of non-delivery (e.g., no tracking updates, communication with the delivery service).
- Detailed photos showing the physical condition of the item after shipping.
7. Governing Law
- These terms are governed by the laws of the State of the Seller.
